Szanowni Państwo,
Niniejszy rocznik inicjuje nową serię wydawniczą Instytutu Wymiaru Sprawiedliwości, zatytułowaną Yearbook of the Institute of Justice in Warsaw. Jej celem jest zaprezentowanie szerszemu gronu odbiorców wybranych raportów Instytutu, przygotowanych w danym roku.
Instytut Wymiaru Sprawiedliwości jest jednostką naukową-badawczą, nadzorowaną przez polskie Ministerstwo Sprawiedliwości. Jej celem statutowym jest prowadzenie badań naukowych m.in. z zakresu: prawa i postępowania cywilnego, prawa i postępowania karnego, kryminologii, prawa porównawczego oraz analiz wymiaru sprawiedliwości. Szczególną i unikatową cechą działalności Instytutu jest badanie praktyki sądowej poprzez analizę akt spraw sądowych i prokuratorskich. Efektem tych prac jest przygotowywanie licznych raportów dostępnych zawsze w postaci on-line na stronie IWS (www.iws.gov.pl), a także publikowanych w kwartalniku „Prawo w Działaniu”. Raporty te są udostępniane przede wszystkim w języku polskim.
W celu upowszechnienia wyników badań Instytutu i uczynienia ich bardziej dostępnymi w obszarze międzynarodowym uznano za konieczne udostępnienie ich w wersji anglojęzycznej. Wybrane raporty, w szczególności te, które mogą mieć znaczenie uniwersalne, będą publikowane w Yearbooku, który będzie dostępny w formule open access. Inicjatywa ta wpisuje się w 35. rocznicę istnienia Instytutu Wymiaru Sprawiedliwości, który formalnie powstał 1 lipca 1990 r. z połączenia poprzednio istniejących jednostek – Instytutu Badania Przestępczości i Instytutu Badania Prawa Sądowego.
W tegorocznej edycji Yearbooka znajdują się teksty z zakresu: prawa cywilnego, prawa rodzinnego, prawa karnego, analiz wymiaru sprawiedliwości oraz praw podstawowych. W szczególności polecam uwadze tekst autorstwa E. Holewińskiej-Łapińskiej, M. Domańskiego oraz J. Słyka pt. „The Family Judiciary System in Poland and the Proposed Assumptions for Its Reform”, który omawia systemowe problemy organizacji sądownictwa rodzinnego w Polsce, oraz artykuł P. Mostowika pt. „Incapacitation of an Adult or Similar Protection Measure, Guardianship and Curatorship in Cross-Border Situations: Current Polish Law with Reference to EU Commission Proposals of 2023”. Autor tego opracowania mierzy się z fundamentalnym zagadnieniem opieki nad osobami dorosłymi z niepełnosprawnością i formami ich ochrony w wymiarze międzynarodowym. W tym numerze znajdziecie także Państwo raport z drugiego już ogólnopolskiego badania wiktymizacyjnego.

Foreword
Dear Readers,
This yearbook inaugurates a new publication series of the Institute of Justice, entitled Yearbook of the Institute of Justice in Warsaw. Its purpose is to present to a broader audience selected reports prepared by the Institute in a given year.
The Institute of Justice is a research and scientific institution supervised by the Polish Ministry of Justice. Its statutory mission is to conduct research in, among other fields, civil law and civil procedure, criminal law and criminal procedure, criminology, comparative law, and analyses of the justice system. A particular and unique feature of the Institute’s work is the study of judicial practice through the analysis of court and prosecutorial case files. These efforts result in numerous reports, always available online on the Institute’s website (www.iws.gov.pl) and published in the quarterly Prawo w Działaniu (“Law in Action”). These reports are primarily made available in Polish.
In order to disseminate the Institute’s research results more widely and to make them more accessible internationally, it has been deemed necessary to publish them in English. Selected reports – especially those with potentially universal relevance – will be published in the Yearbook, which will be available in an open access format. This initiative coincides with the 35th anniversary of the Institute of Justice, formally established on 1 July 1990 through the merger of two previously existing units: the Institute for the Study of Crime and the Institute for the Study of Judicial Law.
This year’s edition of the Yearbook includes texts in the fields of civil law, family law, criminal law, justice system analysis, and fundamental rights. I particularly recommend the article by E. Holewińska-Łapińska, M. Domański and J. Słyk entitled „The Family Judiciary System in Poland and the Proposed Assumptions for Its Reform”, which discusses systemic issues concerning the organisation of family courts in Poland, as well as the article by P. Mostowik entitled “Incapacitation of an Adult or Similar Protection Measure, Guardianship and Curatorship in Cross-Border Situations: Current Polish Law with Reference to EU Commission Proposals of 2023”. The author of this study addresses the fundamental issue of care for adults with disabilities and the forms of their protection in the international context. This volume also contains a report on the second nationwide victimisation survey.
