SECTION OF CRIMINAL LAW AND PROCESS

The Criminal Law and Process Section examines substantive and procedural criminal law.

 

The section includes works covering:

– research in the field of substantive and procedural criminal law in the light of judicial and prosecutor’s practice,

– research on the implementation of penalties and penal measures,

– legal and comparative analyzes,

– issues of international legal instruments related to criminal law.

Detailed studies of a criminological nature include analyzes on the issues of juvenile delinquency and responsibility, probation issues, analysis of domestic and foreign studies on the use of diagnostic and prognostic tools, especially in the context of return to crime, the functioning of mediation institutions in criminal cases and in juvenile cases.

CIVIL LAW AND PROCESS SECTION

The Civil Law and Process Section conducts research and analyzes concerning the functioning of institutions in the field of substantive and procedural civil law in the judicial practice of common courts.

 

The subject of interest of the members of the Civil Law and Process Section are in particular issues related to:

– the jurisdiction of common courts,

– alternative and amicable dispute resolution methods,

– taking evidence, etc.

The section also includes research on employee redress.

FAMILY LAW SECTION

The Family Law Section conducts research on the functioning of substantive family law institutions in the practice of justice and related procedural regulations.

 

Among the scope of the research conducted within the section, the following should be mentioned:

– analysis, consultation and evaluation of draft legal changes in the field of family law,

– verification based on the results of empirical research of the effectiveness of the solutions introduced under family law,

– monitoring the need for changes in the applicable law, reported, inter alia, by representatives of the community of family judges and probation officers and determines the directions of reform of the family judiciary system.

The Economic Analysis Section of the Justice System

 

The Economic Analysis Section of the Justice System carries out economic, statistical and sociological research on the system of justice, its individual institutions and their effectiveness.

The section’s scope of work includes the following areas:

– performance indicators of the judiciary,

– jurisdiction of courts and other entities and organizational units,

– opinion polls and opinion polls by representatives of various professional groups

– economic and statistical analyzes of legal provisions.

The tasks of the section also include monitoring the needs and social assessments of the judiciary, its statistical and media image as well as the costs and effects of the functioning of this system. Section members also support research projects carried out in other sections of the Institute, especially in the field of sample selection for research, construction of research tools and databases, statistical analyzes and assessment of the effects of proposed legal and organizational changes.

FUNDAMENTAL LAW SECTION

 

The Fundamental Rights Section conducts research and analyzes concerning the functioning of legal institutions relating to the public and private sphere, including the jurisprudence practice of the Constitutional Tribunal, Supreme Court and national courts, the ECtHR, the CJEU as well as the activities of international and European organizations and institutions.

 

The research carried out within the Fundamental Rights Section in particular concerns, also from an interdisciplinary perspective:

– axiological assumptions of legal institutions,

– the content of the basic principles of the Polish legal order, including in the area of human rights and institutions aimed at protecting its dignity and family autonomy,

– means of guaranteeing these principles in the aspect of international law.

CENTER FOR STRATEGIC ANALYSIS

 

The Center for Strategic Analysis monitors and develops medium- and long-term activities in the area of justice, coordinates cooperation with external experts in this area, including international cooperation, organizing conferences, seminars, courses and carrying out activities in the field of legal education.

The project of the Center is, among others Law Leaders Lab and the international project Law, Economy and Technology for the Prevention of the Causes of Crime.
