More effective protection for farmers and children with disabilities, the effectiveness of the law in terms of cybercrime, and the issue of freedom of conscience – these are the topics that the third edition of the Polish-Hungarian Research Platform 2023 will address. The official launch of the Polish-Hungarian Research Platform 2023 will take place on Wednesday, April 5.
The aim of the Polish-Hungarian project is to revive international cooperation among lawyers and to develop new methods of drafting projects and legislative demands. – With our projects in Central Europe, we want to break the monopoly of Western European research centers,” believes Dr. Marcin Wielec, professor at UKSW and director of the Justice Institute.
The Polish-Hungarian Research Platform project will establish four international research teams ranging from the legal protection of farmers, the protection of children with disabilities, the issue of freedom of conscience and the effectiveness of the law in terms of cybercrime. Each team will be composed of prominent representatives of legal sciences, both theoreticians and legal practitioners.
The goal of the first team is to research more effective protection of farmers in the context of current threats, taking into account, among other things, aspects and considerations of the Common Agricultural Policy, legal instruments for the protection of farmers, including the welfare of livestock, contemporary legal considerations of the agricultural real estate market and countering food waste.
Drugi zespół zajmie się badaniami nad skuteczniejszą ochroną dzieci niepełnosprawnych w kontekście aktualnych zagrożeń wynikających z funkcjonowania w społeczeństwie. Badacze mają uwzględnić m. in. aspekty i uwarunkowania dotyczące oceny obowiązującego i planowanego prawodawstwa (norm prawa krajowego i międzynarodowego), propozycji nowych lub aktualizacji obowiązujących rozwiązań prawnych ochrony dzieci niepełnosprawnych oraz przyszłych wyzwań związanych z rozwojem nowych technologii.
Trzeci zespół naukowców zajmować się będzie zagadnieniem wolności sumienia w aspekcie instytucjonalnym, z uwzględnieniem m. in. aspektów i uwarunkowań dotyczących problemów teoretycznych i praktycznych wolności sumienia i klauzuli sumienia. Platforma badawcza będzie służyć do wymiany poglądów na doktrynę prawną odnośnie wolności sumienia, orzecznictwa dotyczącego wolności sumienia w aspekcie instytucjonalnym oraz Europejskiego Trybunału Praw Człowieka w Strasburgu.
The fourth team of legal scholars will seek new solutions to increase the effectiveness of cybercrime law, taking into account aspects and considerations regarding proposals for new or updating existing definitions of cyber and cybercrimes (including cyber bullying) in the face of technological advances in the 21st century. Researchers will address updating the categorization of cybercrimes by the asset attacked, typification of currently known and new types of crimes. The team is expected to develop proposals for new or improving existing methods of prosecuting and countering cybercrime while maintaining human rights protection standards, as well as a proposal for new or upgrading existing types of electronic evidence used in criminal proceedings. During its research, the team will evaluate current and planned legislation, including the principles of the relationship of national, international and EU law in cybercrime cases, the jurisdiction of the courts, and assess the current standards of international cooperation in this area. The aim of the research is to increase the effectiveness of international cooperation, to develop proposals for methods to protect special social groups from cybercrime (e.g., children or the elderly), and to forecast future crime trends in the digital world, e.g., with the use of artificial intelligence.
